Pre and Post Deployment: Rethinking Shared Responsibility to Safeguarding Overseas Filipino Workers Rights and Welfare

Abstract

Labor migration remains a critical pillar of the Philippine economy, with more than 1.8 million Overseas Filipino Workers (OFWs) contributing significantly through remittances that sustain families and support national development. Despite comprehensive pre-deployment regulations and bilateral labor agreements, OFWs continue to face abuse, exploitation, and vulnerability during the post-deployment stage. This study reexamines the concept of shared responsibility in safeguarding OFWs’ rights and welfare across the migration cycle. The study employed a qualitative research design using document analysis and thematic analysis. It examined existing pre- and post-deployment systems and assessed the shared responsibilities of key stakeholders, including the Department of Migrant Workers, Overseas Workers Welfare Administration, recruitment agencies, foreign employers, and host governments. Policy documents, implementation guidelines, and institutional reports were analyzed to identify systemic gaps and coordination challenges. Findings indicate that the Philippine pre-deployment framework is relatively structured and policy-driven, with established protocols and compliance mechanisms. However, post-deployment systems reveal persistent gaps in institutional accountability, inter-agency coordination, enforcement consistency, and monitoring mechanisms. Despite robust legal frameworks, weak implementation, limited transparency, and fragmented stakeholder responsibilities continue to expose OFWs to risks abroad. The study concludes that safeguarding OFWs requires moving beyond regulatory sufficiency toward operational coherence and shared accountability. It proposes an enhanced Shared Responsibility Framework emphasizing integrated monitoring systems, data-driven post-deployment support, clearer delineation of stakeholder roles, and strengthened enforcement mechanisms. By institutionalizing transparent coordination and proactive protection strategies, the Philippines can better safeguard migrant workers’ rights while sustaining the long-term socioeconomic benefits of labor migration.
